These Terms of Service ("Terms") govern your access to and use of the Trehko web application and related services ("Service") operated by Trehko LLC ("Trehko," "we," "us," or "our"), a Wisconsin limited liability company. Please read these Terms carefully before using the Service.
1 Acceptance of Terms
By accessing or using Trehko, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Trehko LLC. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2 Eligibility
You must be at least 13 years old to use Trehko. Users under the age of 18 may only use paid subscription features with verifiable parental or guardian consent. By creating an account or using the Service, you represent and warrant that you meet these eligibility requirements.
To subscribe to Trehko Elite or Coach Pro, you must be at least 18 years old and have a valid payment method.
Trehko does not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate that account and delete associated data promptly.
3 Accounts
You may use certain features of Trehko without an account. To access personalized features — including your wishlist, training data, and Elite subscription — you must create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when creating your account.
- You must notify us immediately of any unauthorized use of your account at support@trehko.com.
- You may not create more than one account per person or transfer your account to another person.
We reserve the right to suspend or terminate accounts that violate these Terms.
4 Subscriptions & Billing
Trehko Elite
Trehko Elite is a paid subscription that unlocks additional features. Current pricing:
- Monthly — $3.99 per month, billed monthly
- Annual — $34.99 per year, billed annually
Prices are in US dollars and subject to change with 30 days notice to existing subscribers.
Billing & Renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled.
- You authorize Trehko to charge your payment method on file at the start of each renewal period.
- Failed payments may result in suspension of Elite features until payment is resolved.
Cancellation
- You may cancel your subscription at any time through your account settings.
- Cancellation takes effect at the end of the current billing period — you retain Elite access until then.
- We do not provide prorated refunds for partial billing periods.
Refunds
All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at support@trehko.com within 14 days of the charge.
5 Coach Accounts
Trehko offers two tiers of coach access for endurance coaches and training organizations.
Coach Free
Coach Free accounts provide access to all coaching tools for up to 3 active athletes at no cost. No credit card required.
Coach Pro
Coach Pro is a paid subscription at $40 per month, billed to the admin coach. Coach Pro includes unlimited athletes and the ability to invite unlimited sub-coaches under a single organization account.
The admin coach is the billing owner and is responsible for all charges associated with the organization's subscription. Sub-coaches operate under the admin coach's account and do not have billing access or the ability to manage organization settings.
Athlete access to training calendar features is granted through coach invitation and is tied to the coach's active subscription. If a coach subscription lapses or is cancelled, athlete training calendar access is suspended at the end of the billing period.
Coach Pro subscriptions follow the same auto-renewal, cancellation, and refund policies as Trehko Elite subscriptions described in Section 4.
6 Athlete Data and Coach Relationships
When a coach invites an athlete to Trehko by email, the athlete creates their own independent Trehko account and retains full ownership of their personal data.
Coaches may view training data, workout completions, and feedback submitted by athletes within their active roster. This access is limited to the duration of the active coaching relationship.
When a coach inactivates an athlete, the coach loses access to that athlete's future activity data. Historical training data from the coaching period is retained by Trehko for record-keeping purposes and may be reactivated if the coaching relationship resumes.
Athletes may disconnect from a coach at any time by contacting support@trehko.com.
7 Free Plan
Free accounts provide access to core race discovery features including race search, map view, filtering, and browsing. Free accounts may save races to their wishlist subject to usage limits that may change over time with reasonable notice.
We reserve the right to modify, limit, or discontinue features available on the free plan at any time with reasonable notice.
8 Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of Trehko or third parties
- Submit false, misleading, or fraudulent race reviews or information
- Attempt to gain unauthorized access to the Service or its infrastructure
- Scrape, crawl, or extract data from the Service without written permission
- Use automated tools to access or interact with the Service
- Interfere with the operation of the Service or other users' access to it
- Transmit malware, viruses, or harmful code
- Harass, threaten, or harm other users
Violation of these restrictions may result in immediate account termination without refund.
9 User Content
You may submit race reviews, ratings, and other content ("User Content") through the Service. By submitting User Content, you:
- Represent that you own or have the right to submit that content
- Grant Trehko a non-exclusive, royalty-free, worldwide license to display and use your content within the Service
- Confirm your content is accurate, not misleading, and does not violate any third-party rights
We reserve the right to remove User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate, inaccurate, or harmful.
Race information displayed in Trehko is sourced from publicly available data and third-party sources. We make no guarantee regarding the accuracy, completeness, or timeliness of race listings, registration deadlines, or entry fees. Always verify race details directly with race organizers before making registration or travel decisions.
10 Intellectual Property
The Trehko name, logo, wordmark, app design, race database, and all associated intellectual property are owned by Trehko LLC and protected by copyright, trademark, and other applicable laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.
Nothing in these Terms grants you ownership of any Trehko intellectual property. Your use of the Service does not transfer any IP rights to you.
11 Third-Party Services
Trehko integrates with third-party services including Stripe (payments), Supabase (database), and OneSignal (notifications). Your use of these services is also governed by their respective terms and privacy policies.
Trehko contains links to external race registration pages and organizer websites. We are not responsible for the content, policies, or practices of any third-party websites or services. Accessing external registration links is at your own risk.
12 Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Trehko does not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Race information, dates, fees, or registration deadlines are accurate or current
- Push notifications will be delivered on time or at all
- The Service will meet your specific requirements
You use the Service and rely on race information at your own risk. Always verify critical race details — including registration deadlines, course information, and entry fees — directly with race organizers.
13 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREHKO LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
In no event shall Trehko's total liability to you for all claims exceed the greater of (a) the amount you paid to Trehko in the 12 months preceding the claim, or (b) $10 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
14 Termination
You may stop using the Service and delete your account at any time. Active Elite subscriptions must be cancelled separately before account deletion.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.
Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account data in accordance with our Privacy Policy
- Active subscription fees for the current billing period are non-refundable
- Provisions of these Terms that by their nature should survive termination will survive
15 Account Deletion and Data Retention
You may request deletion of your account at any time by contacting support@trehko.com. Upon account deletion, your personal data will be removed from active systems within 30 days, except where retention is required by applicable law or for legitimate business purposes including fraud prevention and financial record-keeping.
For paid subscribers, account data is retained for 90 days following subscription cancellation or lapse to allow for reactivation. After 90 days, data is permanently deleted.
Training data associated with a coach-athlete relationship may be retained in anonymized form for platform analytics purposes.
16 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service that cannot be resolved informally will be resolved through binding arbitration conducted by a single arbitrator under the rules of the American Arbitration Association, rather than in court.
You agree that any arbitration will be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against Trehko.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters involving intellectual property or unauthorized access to the Service.
18 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification through the app.
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service.
For changes that materially affect your rights or obligations, we will provide at least 30 days notice before the changes take effect.
